BVB Event & Catering GmbH, Rheinlanddamm 207-209, 44137 Dortmund (henceforth ‘BVB’; for details see our imprint), operates the internet portal ‘BVB.de’ as well as other mobile services on the following website and the web pages contained therein: www.event.bvb.de (henceforth ‘BVB.de’). ‘BVB.de’ refers to information services offered by BVB (henceforth ‘BVB.de’ services) and whose use is governed by the following provisions.
2. Use of ‘BVB.de’ services
The use of ‘BVB.de’ services is in principle without cost, taking into account the fact that the user shoulders the cost of an internet connection and the associated cost of the technical means to operate such a connection. BVB attempts to deliver up-to-date information to the best of its knowledge, but assumes no responsibility for the timeliness, accuracy, or completeness of information presented. ‘BVB.de’ services are not to be accessed by persons for whom, for reasons of place of residence, citizenship or otherwise, are prohibited from using ‘BVB.de’ services. In particular, we cannot not guarantee that ‘BVB.de’ services will meet the expectations or demands of the user, nor that such services will be secure, timely, fully functional, free from error or interruption of service, or that the servers accessed to connect with ‘BVB.de will be free form computer viruses or other harmful content.
6. Liabilities
Users are excluded from pursuing damage claims against BVB. Exempt from this rule are claims for damages due to injury to life, body and health, or in case of violation of contractual
duties (cardinal obligations), as well as liability for other damages based on intentional or grossly negligent breaches of duty committed by BVB, its legal representatives or agents. Material contractual obligations are those whose performance to achieve the goal of the contract is necessary. In the event of infringement of fundamental contractual obligations, BVB is only liable for breach of primary contractual obligations in cases of damage of a nature that is foreseeable and typical for this type of contract and is caused by recklessness, unless the customer claims damages relating to injury to life, body or health. Officers, employees, representatives, and contracted parties of BVB are protected by the same waiver/limitation of liability that applies to BVB.
7. Links and/or referrals to third-party websites
‘BVB.de’ and/or ‘BVB.de’ services contain links and/or referrals to third-party websites. BVB assumes no responsibility for the timeliness, accuracy, or completeness of information presented on such sites. In particular, BVB assumes no responsibility for infringements of trademarks, personal rights and associated rights. Any and all legal claims or lawsuits arising in connection with the website ‘BVB.de’ or the use of ‘BVB.de’ services shall be subject to the interpretation of the laws of the Federal Republic of Germany, except for the provisions of international private law. If any of the individual terms of use or part thereof are or become invalid, the validity of the remaining terms shall in no way be affected. The ineffective or missing conditions will be replaced by the respective legal regulations.
